Navigating the streets as a young Black, Caribbean, or mixed-race man in the UK often comes with an unspoken, unjust tax: the high probability of being stopped and searched by the police. Statistics consistently show that Black individuals are disproportionately targeted under stop-and-search powers. In a climate where a routine encounter can quickly escalate, knowledge isn’t just power—it is a shield, a tool for accountability, and a mechanism to ensure you return home safely.
Understanding your legal rights during a police encounter is an essential survival and civic skill. Here is a breakdown of why this knowledge matters and the core rights you need to memorize.
The Power of Calm and Confidence
When a police officer detains you, adrenaline spikes. This is a natural survival response. However, knowing the legal boundaries of what an officer can and cannot do allows you to remain calm.
Securing your rights is not about being argumentative or confrontational; it is about objective clarity. When you know the law, you can comply calmly while firmly holding officers to their legal obligations. This professional boundaries-focused approach protects you from unfair escalation and ensures you do not inadvertently give up your protections.
The Essential Rights: What You Need to Know
If you are stopped by the police, remember the acronym G.O.W.I.S.E. Before an officer can search you, they must provide you with this information:
- G – Grounds: They must state the clear, reasonable grounds for suspecting you have a prohibited item (e.g., weapons, drugs, stolen property).
- O – Object: They must tell you exactly what item they are looking for.
- W – Warrant card: If the officer is plain-clothed, they must show you their warrant card.
- I – Identity: The officer must give you their name and collar number.
- S – Station: They must name the police station where they are based.
- E – Entitlement: They must inform you that you are entitled to a copy of the search record, either immediately or by visiting a station within three months.
If an officer fails to provide these details, the search may be unlawful.
Knowing the Limits of a Public Search
In a public place, an officer’s search powers under standard laws (like Section 1 of the Police and Criminal Evidence Act) are strictly limited regarding clothing.
An officer can only ask you to remove your J.A.M.:
- Jacket
- Astrocoat / Outer Coat
- Mit/Gloves
They cannot force you to remove any more clothing—such as a t-shirt, hoodie, or shoes—in public view. Anything more thorough, including a strip search, must be conducted out of public view, usually at a police station, and requires higher authorisation and strict procedural safeguards.
Section 60: The Exception
It is also vital to understand Section 60 of the Criminal Justice and Public Order Act. When a Section 60 order is active in a specific area, police do not need reasonable suspicion to search you.
However, they still must follow the other procedural rules (like telling you their name, station, and reasons for the area-wide order). Even under Section 60, you maintain your right to be treated with dignity and to receive a record of the search.
Holding the System Accountable
Knowing your rights matters because the data collected from these interactions shapes police reform. If you believe you were stopped purely based on your race, or if the police breached procedure, knowing the law gives you the platform to lodge a formal complaint or seek legal redress later.
Always try to remember or write down the time, date, location, officer details, and exactly what was said. If you are with friends, they have a right to film the interaction from a safe, non-obstructive distance.
